1. Agreement to Terms

By accessing and using Creator Desk ("Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Creator Desk is a comprehensive business management platform designed for content creators. Our Service includes the following features and modules:

  • Financial Management: Invoice generation, income and expense tracking, and financial reporting

  • Project Management: Client database, project tracking, Link Manager, and Project Alerts

  • Content Management: Digital Content Library for video storage and organization, and Smart Contract Builder for creating professional contracts

  • Social Media Planner: Multi-platform scheduling, Kanban board workflow, AI-powered content tools, and automated posting to connected social media accounts

  • Goals Dashboard: Personal and business goal tracking with milestone management

  • Document Management: Cloud-based file storage and organization

  • Third-Party Integrations: Connections to social media platforms, Google Drive, and payment processors (Stripe, PayPal)

3. User Accounts and Registration

To access certain features of our Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activities that occur under your account

  • Providing accurate and up-to-date information

  • Notifying us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations

  • Upload, store, or transmit malicious code or harmful content

  • Attempt to gain unauthorized access to our systems

  • Interfere with or disrupt the Service

  • Use the Service for any illegal or unauthorized purpose

  • Reverse engineer, decompile, or attempt to extract source code from any part of our platform

  • Engage in data scraping, harvesting, or automated extraction of information

  • Use our platform to gather competitive intelligence or develop competing services

  • Create multiple accounts or fake accounts for data collection purposes

  • Use automated tools, bots, or scripts to access our platform without authorization

4.1. Platform Security and Anti-Competitive Activities

To protect our platform, users, and intellectual property, Creator Desk strictly prohibits the following activities:

Reverse Engineering Prohibition

Users are expressly forbidden from reverse engineering, decompiling, disassembling, or attempting to derive the source code, algorithms, methods, or trade secrets of Creator Desk or any of its underlying technology, including but not limited to:

  • API endpoints and authentication mechanisms

  • Database structures and queries

  • Proprietary algorithms and business logic

  • User interface components and design patterns

  • Security measures and encryption methods

Data Scraping and Harvesting Restrictions

Automated data extraction, screen scraping, web crawling, or bulk downloading of content from our platform is strictly prohibited without explicit written permission, including:

  • User-generated content and metadata

  • Platform features and functionality information

  • Pricing, billing, or subscription data

  • Analytics and performance metrics

  • Any form of automated data collection or monitoring

Competitive Intelligence and Espionage

Using our platform to develop, enhance, or operate competing services, or to gather intelligence about our business is strictly forbidden:

  • Market research for competing platforms or services

  • Feature analysis for competitive product development

  • User behavior monitoring for competitive advantage

  • Business model or pricing strategy intelligence

  • Technology stack or infrastructure reconnaissance

Detection and Enforcement

Creator Desk employs comprehensive monitoring and security measures to detect violations:

  • Advanced IP address tracking and behavioral analysis

  • Automated detection of suspicious access patterns

  • Security event logging and real-time monitoring

  • Machine learning algorithms to identify unauthorized activities

Violations will result in immediate account suspension, permanent ban from our platform, addition to our security blacklist, legal action including but not limited to injunctive relief and monetary damages, and may be reported to relevant authorities and industry partners.

5. Social Media Integration and Automated Posting

Our Service integrates with third-party social media platforms including Twitter/X, Instagram, TikTok, YouTube, and Facebook. By connecting your social media accounts, you authorize us to:

  • Access your account information and post content on your behalf

  • Schedule and automatically publish posts at times you specify

  • Retrieve analytics and engagement data from your accounts

  • Store encrypted access tokens to maintain your connection

User Responsibilities for Social Media:

  • You are solely responsible for all content posted through our automated publishing features

  • You must comply with each platform's terms of service and community guidelines

  • You must have the legal right to post any content you schedule, including proper licensing for images, music, and other media

  • You are responsible for any consequences, including account suspensions or penalties, resulting from content posted through our Service

Creator Desk is not responsible for the policies, actions, or availability of third-party social media platforms. Platform API changes or outages may affect the availability of our integration features.

5.1 Content Management and Smart Contracts

Our Content Management features include the Digital Content Library and Smart Contract Builder:

  • Digital Content Library: You retain full ownership of all content you upload. You are responsible for ensuring you have the rights to store and manage any content in your library.

  • Smart Contract Builder: Contracts created using our tools are for your own use. Creator Desk does not provide legal advice, and you are responsible for ensuring your contracts comply with applicable laws.

Creator Desk is not a party to any contracts you create and is not responsible for the enforceability or legal validity of user-generated contracts.

​

5.2 Google Drive Integration

When you connect Google Drive, you authorize us to access files you specifically select for import into your Digital Content Library. We only access files you explicitly choose and do not scan or access other files in your Google Drive. You can disconnect Google Drive at any time from your Profile settings.

5.3 Payment Link Integration

Our Service allows you to generate payment links through Stripe and PayPal for inclusion in invoices. You are responsible for maintaining your own accounts with these payment processors and complying with their terms of service. Creator Desk does not process payments directly and is not responsible for payment disputes, chargebacks, or issues with payment processor accounts.

6. Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Subscription and Billing

Certain features require a paid subscription. Subscription fees are charged in advance and are non-refundable except as required by law. We reserve the right to change subscription pricing with 30 days notice.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Creator Desk and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

11. Limitation of Liability

In no event shall Creator Desk be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
